NEW ORLEANS (WVUE) – A local crime watchdog called Tuesday’s arrest of New Orleans Police Department Sgt. Henry Burke a step in the right direction, saying the criminal investigation could help the city recover lost funds.

Metropolitan Crime Commission president Rafael Goyeneche said the allegations against Burke undermine public confidence in law enforcement.

“It’s never a happy day that we see a betrayal of the public trust committed by a police officer,” Goyeneche said.

Goyeneche said the case is especially concerning as the city faces a $222 million budget shortfall.

“The police department … exceeded their overtime budget greatly, and the reason that that budget was exceeded was because City Hall didn’t appropriately allocate overtime funds,” Goyeneche said. “But cases like Sergeant Burke, that is an extreme abuse.”

Burke is criminally accused of payroll fraud and falsifying public records while working for the NOPD. Goyeneche said the charges likely are most upsetting for Burke’s colleagues.

“People that are most angry about this are going to be the men and women of the police department that work hard for their money and actually do perform the services they’re being paid for,” Goyeneche said.

Accountability and potential consequences

Goyeneche said Burke’s arrest shows a push for accountability.

“Today, the accountability process actually started when he was booked and charged with a total of 10 different felony counts,” Goyeneche said.

According to attorney and Fox 8 legal analyst Joe Raspanti, Burke could be ordered to repay the city funds he didn’t rightfully earn. Raspanti said Burke also faces prison time if convicted.

“These charges carry up to (a) five-year penalty. (They) have restitution as part of the sentence,” Raspanti said. “So, I think that what you’re going to see is a very serious prosecution. And if they get their … documents and their videos and their timelines lined up, I think this would be a very straightforward prosecution.”

The city’s communications office did not respond to requests for comment on Burke’s arrest.
